The slave owner was entitled to sell the slaves because of his ownership of the property. In the event of a lawsuit, however, the white attorneys would argue that their clients had been born in America, were citizens, and thus, were free property. This is why you see the phrase 'free born,' rather than 'free person' in most cases. This was a more open line of argument, and it shows that you understand the concept of 'ownership.' The Supreme Court cases in such plantation owners, where the concept of ownership was really one of convenience. They were more interested in whether the owner held the actual title to the property, which would entitle him to sue and seek compensation for the slaves, or if he held a fictitious title to the property, which he could not sue over. It was because of this that the U.S. government tried to clarify the meaning of slavery, and how the term applied to the free states. Because of the unique nature of the system, today the term 'ownership' has changed, and it has to do with the fact that the slave's very life was deemed valuable. This gave way to what today we know as 'property,' which includes all sorts of things, including land, vehicles, or even animals. In a decent country, you should not be forced to do something against your will. If you are unable to help someone else or your own people out of trouble, you shouldn't be forced to do so. That, though, is an argumentative essay topic. The court determined that there was no law against slavery, but that the owner of the slaves could sue to regain his property. That is not a valid argumentative essay topic because it involves laws. You are suggesting that such laws were set in place to protect an owner, and to further such a purpose. That cannot be right.
